In this paper I offer a first account of a practice-based conception of normativity for the political domain. This standpoint is used to relocate the most sophisticated normative practices of justification and critique within an experience-based framework, that of the human being as a “normative creature.” I begin by discussing the two major paradigms in political theory, showing that their neglect of this broad framework of normativity is a serious drawback. I then proceed to articulate the central elements of a (...) practicebased account of normativity: the notions of normative practices and normative orders, and an account of the rationality potential of normativity as practice. In this paper, I propose a new nonconceptual reading of the B-Deduction. As Hanna correctly remarks :399–415, 2011: 405), the word “cognition” has in both editions of the first Critique a wide sense, meaning nonconceptual cognition, and a narrow meaning, in Kant’s own words “an objective perception”. To be sure, Kant assumes the first meaning to account for why the Deduction is unavoidable. And if we take this meaning as a premise of the B-Deduction, then there is a gap in (...) the argument since the categories are certainly not conditions for non-conceptual cognition. Still, I believe it is not this wide meaning but rather the narrow one that figures in any premise of the B-Deduction. Thus, in the reading that I am proposing, categories are not conditions for representing something, or even conditions for representing something objectively. Instead, they are conditions for the recognition that what we represent through the senses exists mind-independently. In the first step of the B-Deduction, this cognition in the narrow sense takes the form of the propositional thinking that the nonconceptually represented object of the sensible intuition exists objectively. In contrast, in the second step of the B-Deduction, this cognition in the narrow sense takes the form of the apprehension of what our human senses represent nonconceptually as existing objectively. Resumo: A salvaguarda do ser na verdade é uma expressão empregada por Martin Heidegger no período conhecido como hermenêutica da facticidade. Apesar de referências e análises ocasionais, que pontualmente a desenvolvem em vista de outros assuntos, tal temática é, de modo geral, pouco desenvolvida por parte da literatura secundária. O artigo sugere que a explicitação do termo salvaguarda e conceitos correlatos não é apenas uma tarefa ineludível, em vista de sua constância na trajetória intelectual de Heidegger, mas que ela toca (...) no cerne da questão do sentido do ser. A análise inicia com um exame da salvaguarda do ser a partir do Informe Natorp para, em seguida, apontar continuidades, quebras e reformulações em relação ao tratamento do tema da guarda em obras da década de 1930. The alleged neural basis of empathic responses to artworks is only of marginal relevance for aesthetics and for cognitive theories of art.

This paper presents a new cognitivist account for the old puzzle of self-consciousness or knowing self-reference. Knowing self-reference does not rely on reflection on some putative pre-existent pre-reflexive self-consciousness, nor is it the result of a process of identification of oneself as the employer of the relevant token of “I” according to the token-reflexive rule of the first-person pronoun. Rather, it relies on the architecture of the cognitive system. By exploiting the acquaintance relation that every brain has to one’s own (...) body, a “mental file” is opened in a subliminal way to house information about oneself gained through the appropriate proprioceptors. Knowing self-reference based on self-files dispenses with self-identification because the opening of the file in the same brain/body is not a deed of the cognitive system but rather something that takes place sub-personally. Content nonconceptualism and State conceptualism are motivated by different readings of what I want to call here Bermúdez’s conditions on content-attribution (2007). In one read- ing, what is required is a neo-Fregean content to solve problems of cognitive significance at the nonconceptual level (Toribio, 2008; Duhau, 2011). In the other reading, what is required is a neo-Russellian or possible-world content to account for how conspecifics join attention and cooperate, contemplating the same things from different perspectives in the same perceptual field. The solution to this apparent contradiction is the rejection of the real content view and the adherence to what I call here Content-pragmatism: there is no such thing as the content of experience. According to content pragmatism, “proposition” is not as real as a mental state, but rather, it is a term of art that semanticists use, as a matter of theoretical convenience, to classify mental states. What follows from Content-pragmatism is Content- pluralism: there are so many contents that are required to meet Bermúdez’s condition on content attribution. Because both criticism and the defense of State conceptualism overlook the real scope of Bermúdez’s condition on content attribution, they are ineffective. In this paper, I will argue that the opposition between State and Content nonconceptualism is a real one, but only a relative one, that is, relative to the opposite constraints to be met. If we want to solve the problems of cognitive significance, the best we can do is to let the content of experience be modeled as neo-Fregean content, namely, a compound of nonconceptual modes of presentation of objects and properties. In this case, Content-nonconceptualism prevails. In contrast, if we want to account for how conspecifics join attention to the same entities in the same perceptual field from different perspectives, the best we can do is let the content of experience be modeled either as a structured Russellian proposition or as a function from possible worlds to truth-values. Management of different types of partnerships plays a decisive role in company performance. Complex business ventures, such as those created to serve low-income populations, usually include both cross- and same-sector partnerships. However, the initial diversity featured in these alliance portfolios diminishes as companies take their ventures up to scale. This article develops theoretical propositions about the evolution and configuration patterns of portfolios that include both cross- and same-sector partnerships. Two longitudinal case studies serve to illustrate the theoretical framework developed for (...) alliance portfolios that include both types of partnerships. Companies that create such portfolios adopt partnership strategies that follow paths also identified in the evolution of portfolios only made up of partnerships with other private firms: i.e., an evolution from adapting to shaping and exploiting strategies. This paper argues that some of the misunderstandings surrounding the meaning and function of the concept of human dignity in bioethics arise from a lack of distinction between two different roles that this notion plays: one as an overarching policy principle, and the other as a moral standard of patient care. While the former is a very general concept which fulfils a foundational and a guiding role of the normative framework governing biomedical issues, the latter reflects a much more concrete (...) and context-specific understanding of the patient as a “person”. The importance of dignity as a policy principle will be described by appealing to the distinction between principles and rules as developed by some legal philosophers. The value of dignity as a standard of patient care will be illustrated with the help of concrete examples and by drawing on the taxonomies of dignity proposed by Jonathan Mann and other scholars. The overall scope of the article is to highlight this double and complementary role of human dignity in bioethics. (shrink)

El artículo analiza desde un punto de vista analítico las estructuras lógicas y lingüísticas del discurso moral y del discurso jurídico, en cuanto a sus códigos prescriptivos, con el fin de determinar la relación que existe entre ambos discursos. Aunque se han hecho esfuerzos a la largo de la historia por garantizar una esfera de autonomía en el sujeto moral, y por evitar la injerencia reguladora externa del brazo del Estado o el poder espiritual de alguna iglesia, no se ha (...) conseguido. Desde planteamientos diferentes se exigen conexiones entre derecho y moral, si bien las relaciones de fundamentación que se postulan entre ambos discursos son vagas y problemáticas. Vernengo rechaza una relación de subalternación del derecho con respecto a la moral. La moral más que fundamento lógico inmediato del derecho, establece un conjunto de razones, no las únicas pues existen otros ingredientes axiológicos, que justifican en los derechos positivos que instituyan deberes y derechos subjetivos. Esto implica rebajar la relación entre derecho y moral a una contingente constatación empírica. (shrink)

The article deals with the lines along which manifold senses of horizonedness emerge and their reference to potentiality as a starting-point. The first section examines Gurwitsch's analyses of field-potentialities and margin-potentialities in the light of distinctions drawn by Husserl in terms of latency and patency. It is contended that Husserl's concept of latency encompasses both modes of potentiality. The second section shows how the world- horizon functions as a background- horizon and alternation- horizon conceived of as the two fundamental modes (...) of non-thematic consciousness. In this respect, an attempt is made to link this theme with Gurwitsch's description of the acquisition of the character of positional index as a worldly existent. The third section is concerned with how potentiality develops into an all-encompassing domain that can be anticipated as an ideal totality and into a pregiven ground, and outlines an approach to the complementarity of this threefold characterization. This development falls out of Gurwitsch's framework for the analysis of horizonedness. The article concludes with a characterization of the encasement-of-one-in-another of horizons. Reasons are suggested for the application of some ideas of Gurwitsch on thematic transformation to this sequence of levels. (shrink)

Se intentan poner de manifiesto isomorfismos estructurales en las teorías de Heidegger y Husserl sobre tiempo e historia. En relación con Ser y tiempo, la atención está puesta en la tesis compartida de que la historiografía está arraigada en la historicidad y esta en la temporeidad. Con referencia al curso de 1934 se pone de relieve la convergencia heideggeriana de misión, encargo y trabajo, que remiten al futuro, al pasado y al presente. Se muestran nociones equivalentes en los niveles que (...) Husserl distingue en la historia: protohistoria, historia efectiva e historia racional. Finalmente, en lo que atañe al viraje, se trazan paralelos entre el Ereignis y el presente viviente como instancias últimas de una indagación restrospectiva, entre la temporeidad del Dasein y al tiempo inmanente como resonancias de una dimensión profunda, y en torno de una conexión mutua en el análisis de la historia en términos de desviación, reposición, incorporación y superación, esto es, los momentos que componen la noción de Gewind. Advanced technologies can shed a new light on traditional discussions related to medical models and social models regarding people and dissabilities. Convergent scientific and technological fields such a synthetic biology, nanotechnology or 3D printers, bring new opportunies to modify bodily biological functionalities. New possibilities for personalize and accesible manufacturing of mechanical and biological prosthesis are very promising regading body rehabilitación and, also, for augmenting and improving natural capacities. Ableism and functional diversity models can be seen from a new perspective, regarding (...) new possibilities for augmented functionalities, in a way that individual options for rehabilitation become a new form of social diversity. This model can be a social model if we admit technological autonomy as a source of individual rehabilitation beyond normative models for standard abilities. (shrink)

Mathematical game theory – developed starting from the publication of The Theory of Games and Economic Behavior , by John von Neumann and Oskar Morgenstern – aims to outline an ideal model of behaviour of rational agents involved in some interaction with other rational agents. For this reason, game theory has immediately attracted the attention of philosophers dealing with practical rationality and, since the fifties, has been applied to the analysis of several issues concerning ethics and philosophy of politics. Here (...) we will focus on one of the most interesting applications of game theory to ethical-political inquiry, i.e., with the game theoretic analysis of some problems related to the evolution of moral norms. Firstly, we will provide a short outline of the development of game theory, which has lead to the formulation of a plurality of different game theories. It will be shown that such theories can be classified in two main groups: rationalistic game theories –in two different versions: classical and epistemic – and evolutionary game theories. Moreover, some basic elements of classical game theory will be introduced and the key ideas of epistemic and evolutionary game theories will be illustrated. Afterwards, the main approaches developed within the ethical-political applications of game theory will be shortly described. Finally, some results obtained in the last twenty years by the researchers who have analysed the evolution of moral norms by the conceptual tools of evolutionary and epistemic game theories, will be examined. Over the last decade, several European countries and the Council of Europe itself have strongly supported the use of advance directives as a means of protecting patients’ autonomy, and adopted specific norms to regulate this matter. However, it remains unclear under which conditions those regulations should apply to people who are placed in correctional settings. The issue is becoming more significant due to the increasing numbers of inmates of old age or at risk of suffering from mental disorders, all of (...) whom might benefit from using advance directives. At the same time, the closed nature of prisons and the disparate power relationships that characterise them mean that great caution must be exercised to prevent care being withdrawn or withheld from inmates who actually want to receive it. This paper explores the issue of prisoners’ advance directives in the European context, starting with the position enshrined in international and European law that prisoners retain all their human rights, except the right to liberty, and are therefore entitled to self-determination regarding health care decisions. El artículo analiza el vínculo entre derecho y violencia en Walter Benjamin y Franz Rosenzweig. Primero, se estudia la relación entre Benjamin, Rosenzweig y Carl Schmitt, y, a continuación, la proximidad entre las concepciones benjaminiana y rosenzweiguiana de la historia y de la temporalidad mesiánica, así como la relación entre justicia, derecho y eternidad. Finalmente, se presenta la propuesta derridiana de una deconstrucción de la crítica benjaminiana de la violencia y su antecedente en _La estrella de la redención_.
